About Fees & Payment Expectations

 

The general rate for mediation and arbitration services with John-Paul Boyd Arbitration Chambers is $400 per hour, plus applicable federal and provincial taxes, for all work performed by John-Paul Boyd including meetings, hearings, telephone calls, correspondence, drafting, review of documents and other services. In most circumstances, clients are also responsible for all reasonable and necessary expenses incurred in connection with the mediation and arbitration proceedings, including experts’ fees, airfare, seat fees and other travel expenses, hotel accommodation, boardroom booking fees, equipment rentals and photocopying when commercial printing services are used. When travelling by car outside the City of Calgary, John-Paul Boyd Arbitration Chambers will be reimbursed for mileage at a rate of $0.45 per kilometer and be paid $200 per hour for travel time.

Writing arbitral awards is notoriously time-consuming when done well. As a general rule, clients should expect that each half-day spent at an arbitration hearing will require one full day of writing time.

Where the parties are represented by lawyers, the arbitration agreement used by John-Paul Boyd Arbitration Chambers makes the parties’ lawyers responsible for the fees of and expenses incurred by John-Paul Boyd. Where the parties are not represented by lawyers, an authorization will be made against each parties’ credit card for one-half of the anticipated total amount of fees and expenses. All fees and expenses are payable at the conclusion of mediation proceedings, where a settlement is reached on all issues, or at the conclusion arbitration hearings and must be paid before the final award will be released.

Payment by lawyer’s cheque or electronic transfer is preferred. Fees and payment expectations are subject to change.

Cancellation fees

Cancellation fees will be charged when a meeting in the mediation proceeding or a conference or hearing in the arbitration proceeding is cancelled by one or both parties.

If notice of the cancellation is received 7 days and 48 hours before the start of the meeting, conference or hearing, the parties will be charged a fee of $750, in addition to John-Paul Boyd’s time spent to the time notice is given preparing for the meeting, conference or hearing, as well as any nonrefundable expenses incurred by John-Paul Boyd Arbitration Chambers for the purposes of the meeting, conference or hearing, including travel expenses, boardroom booking fees, equipment rentals and the like.

If notice of the cancellation is received less than 48 hours before the start of the meeting, conference or hearing, the parties will be charged a fee of $1,500, in addition to John-Paul Boyd’s time spent to the time notice is given preparing for the meeting, conference or hearing and any nonrefundable expenses incurred by John-Paul Boyd Arbitration Chambers.

Independent legal advice

The general rate for independent legal advice services provided by John-Paul Boyd Arbitration Chambers is $400 per hour, plus applicable federal and provincial taxes, for all work performed by John-Paul Boyd including meetings, telephone calls, correspondence, and review of documents.

Practice standards vary between Alberta and British Columbia. In British Columbia, independent legal advice on family law agreements will generally require one to three hours of John-Paul Boyd’s time. In Alberta, independent legal advice on family law agreements involves a full review of financial disclosure and will generally require three to eight hours of time.

Independent legal advice on arbitration agreements will generally require one to two hours of John-Paul Boyd’s time.

Children’s services

The general fee for views of the child reports, drafting children’s affidavits and providing legal advice to children, where the service relates to litigation proceedings in the Alberta Court of Queen’s Bench or the British Columbia Supreme Court, is $400 per hour. In most circumstances, clients are also responsible for all reasonable and necessary expenses incurred to interview children, including airfare, seat fees and other travel expenses, hotel accommodation and, when travelling by car outside the City of Calgary, mileage plus $200 per hour for travel time.

For children’s services relating to mediation proceedings or to litigation proceedings in the Alberta Provincial Court or the British Columbia Provincial Court, the general fee is $200 per hour, plus reasonable and necessary expenses incurred to interview children.

The cost of legal services and access to justice

Lawyers’ fees can, and often do, impose a barrier to Albertans’ and British Columbians’ ability to access family justice. Mediation and arbitration proceedings with John-Paul Boyd Arbitration Chambers are intended to be speedy and cost-effective, and provide a significant savings over the cost of resolving a family law dispute through litigation. However, mediation and arbitration proceedings may still be unaffordable to some Albertans and British Columbians.

Special flat rates are available for services involving views of the child reports, drafting children’s affidavits and providing legal advice to children, and for other work where the scope of the services to be provided by John-Paul Boyd Arbitration Chambers is known and limited. Other considerations, including a reduction of John-Paul Boyd’s general hourly rate, may also be available to lower-income Albertans and British Columbians.
